Photo Contribution Terms

These terms apply to photos you voluntarily contribute to help develop and improve ScrapMax’s material-identification systems, together with labels, descriptions, and confirmation information you submit with them (“contributions”).

These terms supplement ScrapMax’s Terms of Service, including its eligibility requirements. Our Privacy Policy explains how we handle personal information.

What you may submit

Submit only photos for which you own the necessary rights or have permission to grant all permissions described in these terms. This includes any necessary authorization from an employer or other copyright owner.

By making a contribution, you confirm that:

  • You meet the eligibility requirements in the Terms of Service and have authority to agree to these terms.
  • You own the necessary rights or have authorization to grant the permissions below.
  • Your photos show scrap material you are legally permitted to possess and photograph.
  • Your contribution and the uses permitted by these terms do not violate anyone else’s copyright, privacy, confidentiality, or other rights.

Do not submit photos containing people, addresses, license plates, documents, or other private or confidential information.

Permission you give ScrapMax

You keep any ownership rights you have in your contributions.

You give ScrapIQ LLC a nonexclusive, worldwide, royalty-free license to store, reproduce, crop, resize, edit, label, annotate, analyze, display for authorized review, and create modified or derived versions of your contributions.

We may exercise these permissions to develop, train, fine-tune, test, validate, operate, and improve ScrapMax’s machine-learning models, material-identification systems, and related features, including those offered commercially. These activities may include review and labeling by authorized people.

Contributions are voluntary. Unless we separately agree otherwise in writing, you will not receive payment or royalties, and we do not need your further approval for uses permitted by these terms.

This license is subject to the limits and removal provisions below.

Service providers and public use

We may allow service providers working on our behalf to exercise these permissions solely to provide services to ScrapMax for the purposes described above. They must be subject to contractual restrictions on use, confidentiality, and deletion.

This permission does not authorize providers to use your contributions to train models independently for their own purposes.

We will not publish your contributed photos in public galleries or marketing materials, or publicly identify you as the photographer, without your separate permission.

Review and accuracy

We may review, relabel, reject, or exclude any contribution. We are not required to use or retain it.

A submitted label, even when approved, does not guarantee that the label is correct, that similar material will be identified correctly, or that a scrap yard will accept material under that grade.

Photo-based identification does not establish material safety, composition, value, or suitability for handling or processing.

Removal of contributions and account deletion

We maintain an association between retained contributions and your ScrapMax account to support removal.

You may request removal of a specific contribution without deleting your account by emailing contact@scrapmax.app and identifying the contribution. You may request account deletion through the methods described in our Privacy Policy. We may need to verify your identity and identify the contributions covered by your request.

Once we verify your request, we stop further training use of the affected contributions. We remove them from active systems, including training datasets, within 30 calendar days after verification, subject to the limited retention described below. Removal includes original photos, stored derived image copies, and associated labels, descriptions, and confirmation information. We also instruct service providers to delete affected contributions held on our behalf. We will act sooner where required by applicable law.

Residual copies may remain in protected backups for up to 90 calendar days after deletion from active systems and, in any event, no more than 120 calendar days after verification. We may retain the minimum information needed to meet a legal obligation, address a fraud or security incident, or resolve a dispute, only where permitted by law and as described in the Privacy Policy. Access and use are restricted to the relevant retention purpose, and the information is deleted when that purpose ends. Retained contributions are not used for training.

After verification, our license for the affected contributions is limited to processing removal, permitted retention, and the continued model use described below.

Previously trained models

Deleting a contribution does not, by itself, require reversing completed training or retraining an existing model.

Subject to our commitments in the Privacy Policy and applicable law, we may continue to use, operate, and further develop models lawfully trained using your contributions before we verify the relevant removal or account-deletion request, including later versions developed without further training use of the contributions being deleted. Lawfully created anonymous aggregate statistical improvements may also remain.

This continued-use permission survives contribution removal and account deletion. It does not authorize keeping original photos or stored derived image copies beyond the removal and limited-retention provisions above.

Applicable deletion commitments and legal obligations also apply to personal information retained in models. If those commitments or obligations require us to remove information from, modify, delete, or stop using a model, we will do so. Nothing in these terms limits your rights under applicable law.

Relationship to other terms

These terms supplement ScrapMax’s Terms of Service. The acceptable-use requirements, safety provisions, warranty disclaimers, limitations of liability, indemnification provisions, and dispute provisions in the Terms of Service apply to the contribution feature, subject to their stated limits and applicable law.

If these terms conflict with the Terms of Service about the contribution license or the treatment of contributions and previously trained models after removal or account deletion, these Photo Contribution Terms control for that issue.

The Privacy Policy continues to govern our handling of personal information. These Photo Contribution Terms do not reduce the privacy protections we promise in that policy.
